1 These general competition
rules apply to all Energy Radio Ltd competitions. They may be
amended from time to time.
2 Special rules may apply to a particular competition, in
which case an addendum to these rules will be made for that
competition.
3 All prizes
must be collected within 3 months of the date of winning. Prizes
not collected within that period will be forfeited and disposed
of at the discretion of Energy Radio Ltd. Energy Radio Ltd will
not notify winners of the time remaining. It is the sole
responsibility of winners to claim their prizes.
4 Prizes
must be claimed in person unless the winner is otherwise advised
or if the value of the prize is less than £20. Identification
will be required when collecting a prize.
5 In
exceptional circumstances, with the prior permission of Energy
Radio Ltd, a winner may nominate a designated person to collect
a prize on his or her behalf. Identification for both the winner
and the designated person will be required. The interpretation
of "exceptional circumstances" will be at the discretion of
Energy Radio Ltd.
6 In the
event of a winner choosing not to accept a prize, they forfeit
any and all claims to the prize, which can then be awarded to a
runner-up at the discretion of Energy Radio Ltd.
7 Winners
under the age of 18 years must be accompanied by a parent or
guardian. Identification to the satisfaction of Energy Radio Ltd
may be asked for in relation to both the winner and the
parent/guardian.
8 Upon
request by Energy Radio Ltd, any winner must sign and endorse a
copy of these rules to the effect that they comply with the
rules in all respects.
9 Prizes are
non-transferable and may not be redeemed for cash.
10 All prizes
are used/taken entirely at the risk of the winner in all things.
Energy Radio Ltd excludes all warranties in connection with any
prize to the extent permitted by law.
11 Energy
Radio Ltd and its agencies, associates, sponsors and
representatives shall not be responsible for any defective prize
or misuse of any prize or for any claim, liability, loss or
damage arising out of or in connection with any competition
promoted by Energy Radio Ltd.
12 In relation
to any prize involving participation in any activity:-
a) Energy
Radio Ltd and its employees and agents will be fully
released from and indemnified by the winner in respect
of any claim for accident, injury, property damage or
loss of life in connection with the winner’s
participation in the prize;
b) the
winner may, at the discretion of Energy Radio Ltd, be
required to sign a form of indemnity as a precondition
to his or her entitlement to the prize;
c) if a
winner is under the age of 18 years, his or her
parent/guardian must sign an indemnity and consent to
the winner’s participation in the prize.
13 If the
specified prize becomes unavailable due to unforeseen
circumstances, Energy Radio Ltd may substitute a similar prize
or one of equal value.
14 Unless
otherwise specified, the class of travel for any travel prize,
by any mode of travel, will be economy class or equivalent.
15 All
competition winners must agree to being photographed for
publicity purposes if required by Energy Radio Ltd and
acknowledge that Energy Radio Ltd has the right to use such
publicity photographs in any reasonable manner it sees fit.
16 Competition
entries and material submitted in connection with any
competition (whether in written, audio or visual form, or a
combination of any of these) become the property of Energy Radio
Ltd which may use the material in any reasonable manner it sees
fit.
17 Energy
Radio Ltd may broadcast, publicise or otherwise disclose a
winner’s or competitor’s name, character, likeness, statements
or any recording of their voice in advertising or promotional
activities concerning the competition or Energy Radio Ltd
competitions generally. Energy Radio Ltd may promote or
advertise that a particular winner has won a competition.
18 Energy
Radio Ltd may incorporate information given by participants in
any competition in any database established for the purpose of
its business.
19 The winner
is responsible for any tax payable as a result of a prize being
awarded or received.
20 In any
dispute arising out of the use of telephone lines in a
competition, the decision of Energy Radio Ltd will be final.
21 A person is
ineligible to enter a competition if he or she:-
a) is an
employee or a member of the immediate family of an
employee of Energy Radio Ltd or any related radio
station or company or any sponsor or advertising agency
or affiliate associated with the competition;
b) has
won a prize or prizes valued either individually or
collectively at up to £100 in any Energy Radio Ltd
competition in the one month period prior to entering
the competition in question;
c) has
won a prize or prizes valued either individually or
collectively at over £100 in any Energy Radio Ltd
competition in the three month period prior to entering
the competition in question;
d) is
discovered, to the satisfaction of Energy Radio Ltd, to
have used or attempted to use more than one name, or
knowingly to have broken the rules of a competition in a
material way, in order to win a prize from Energy Radio
Ltd.
e)
attempts to gain a prize via means of assistance from a
third party or by any other outside assistance.
22 Should
Energy Radio Ltd learn of a person’s ineligibility after having
appeared to award a prize to that person, Energy Radio Ltd can
apply Rule 21 retrospectively and, where the ineligible person
has already taken possession of the prize, Energy Radio Ltd can
require that person to return the prize or make a payment of
equivalent value.
23 Where
Energy Radio Ltd has special competition rules or conditions of
entry in relation to a particular competition, such special
rules and conditions will prevail in the event of any
inconsistency arising between them and the General Competition
Rules.
24 Any failure
by Energy Radio Ltd to enforce any of these rules in any
instance will not give grounds for any claim by any other
person.
